Based on a case of the European Court of Justice (no. C-179/98 of 11 November 1999, Belgium v. Fathah Mesbah) and the jurisprudence of the European Court of Human Rights, this article proceeds to compare the attitudes of the two Courts and to reflect on the possible influence of the Strasbourg Court upon the Luxembourg Court in the field of nationality-based discrimination.
